PLANNING BOARD

MINUTES OF MEETING

APRIL 2, 1998


PRESENT:  Chairman Tracy Scott, Jeff Andrews, Stan Brehm, Ted Bailey, Harold Arey, Dave Bickert, Skip Lawrence. Paul Adams and Secretary Andrea Deachman

Chairman Scott called the meeting to order at 7:09pm and requested the Board to review the minutes of March 5, 1998.

Motion was made to accept the minutes with changes.

Before this hearing began Chairman Scott informed interested parties if there was any problems like in the March meeting this hearing would be tabled until May 7, 1998 and we would continue with the rest of the agenda.

Peter Holden, Registered Land Surveyor from Holding Engineering, presented final plans to the Board.

ABUTTERS PRESENT:  Larry & Joann Leppard, Robert Shaw, Gilbert & Lis Lazich and Robert McNichol.

Bill Rollins, from SEA Consultants, Inc., Chichester’s Town Engineers, reviewed the property and had many suggestions and comments on the requirements that Mr. Holden had addressed on the plan.

All of the utilities are underground, they have submitted application with District 5 for a driveway permit, piping and paving will be under state requirements, runoff will go into detention pond instead of into fire pond.

State approval for the septic system has not been received as of yet.

Note #9 on plan needs to be changed to read Chichester not Epsom.

Need to change Center Road to Main Street.

Motion was made to approve the plan with the following conditions:  State septic and driveway approval, #9 on plan and Center Road to Main Street.

PUBLIC HEARINGS:                        Subdivision
                                                Map 8, Lot 23, Bear Hill Road

ABUTTERS PRESENT:  Barbara Frangione, Walter Sanborn, Bob Hackney, Russell MacCleary, Zack Boyajian, Rich Huntsberge, Anita Prickett, Peter & Ruth Hammen.

Mr. Plunkett presented the Board with plans for a 5 acre subdivision off of the original parcel, it will be used as a building lot.

Rural agricultural, Steepland and Conservation open space wetlands are the soil types for this lot.

The Board will need setbacks, soil types and owner of record not surveyed for on the final plan.

Motion was made to approve the preliminary plan.

Motion was made to continue the public hearing to May 7, 1998 so the plan can be completed.

PRELIMINARY AND                 Beth Adams
PUBLIC HEARINGS:                        Subdivision
                                                Map 7, Lot 17, Ferrin Road

ABUTTERS PRESENT:  Peter Dobins and Kathy Gagnon.

Peter Arvanitis is representing Beth Adams, presented the Board with plans for the subdivision.  The lot is presently 40.6 acres and she would be making the new lot 12.66 acres.

The Board will require Setbacks, soil types and owner of record instead of surveyed for on the final plan.

Two gentlemen from the audience who did not identify themselves and were not abutters stepped forward and complained that this was a class 6 road and therefore could not be built on, one had a map from the state that showed that this part of Ferrin Road was a class 6 road, but as members looked at this map they found many differences from what the town has done and what was on the plan, roads that have been changed to class 5 roads many years ago are still listed with the state as class 6.

The Board was given a letter from the Road Agent, Bill Stevens, stating that all of Ferrin Road is indeed a class 5 road and 2 Selectmen at the meeting agree.

Motion to decline the subdivision until the portion of Ferrin Road in question is put before the town to make a class 5 road.

Motion dead.

Motion made to move forward.

Stan Brehm Board member will step down as he is an abutter in this hearing.

Dave Bickert will be a voting member for this hearing.

The Board again made it clear that they would have liked to had a mylar to record, but the Zoning Board of Adjustment felt this was not necessary.

The Board stated that if the property changed use or changed hands a mylar will be required.  A letter stating this fact will be registered with the Merrimack Registrar of Deeds.

Members were concerned with handicapped access and parking.

Mr. Conway stated that he was willing to make a ramp for handicapped access and would single out parking for the handicapped.

Motion was made to accept the drawings with the addition of handicapped access and parking.

                                                Map 1, Lot 35 & 35A, Leavitt Road

Mr. Bailey presented the Board with a drawing of where he would like to change the lot line.

The Board requested setbacks from the new lot line, soil types and owner of record.

DISCUSSION:                             Lewis Marston
                                                Site review - Self Storage Building
                                                Map 8, Lot 51, Route 28

Mr. Marston would like to build a self storage building on his lot, his office will be in his house across the street.

Three questions arise with the Board.

Is there driveway access?   Mr. Marston and Mr. Stephen MacCleery say yes there is a driveway access.

Is Self Storage permitted use under our zoning?  We have warehousing and rentals listed in the zoning, do we want to include self storage as warehousing?

A concern of the Boards was the pedestrian traffic from office to building, Mr. Marston feels that with the gates open from 8am to 5pm Monday thru Friday and Half day on Saturday, with only his telephone number listed on the sign people will not be crossing Route 28.

Mr. Adams wanted the Board to remember back to December 1996 with another case before the Board and the Board defeated a storage building as a permitted use, other members felt this was completely different.

Polling of the Board as to whether or not self storage is a permitted use.

6 yes 1 no

Move forward as a permitted use.

Mr. Marston needs to go to district 5 for a driveway permit for this use.

Motion to waive water and sewer requirements contingent upon its use as self storage only.

Motion withdrawn.

Mr. Marston will go to Department of Environmental Services about water and sewer for this use, if water and septic are needed.

Some changes were made, but members felt they needed more time to go through the regulations and checklist.
